Microblogging site Twitter has informed the Delhi High Court that it locked Congress leader Rahul Gandhi’s account for sharing a picture of the parents of the nine-year-old Dalit girl who was allegedly raped and killed at a crematorium in Delhi Cantonment. The tweet has also been taken down, Twitter told the court.
A bench headed by Chief Justice Dhirubhai Naranbhai Patel was on Wednesday hearing a plea filed by activist Makarand Suresh Mhadlekar which sought registration of an FIR against Rahul Gandhi under Section 74 of the Juvenile Justice Act, 2015 and Section 23(2)the Prevention of Children from Sexual Offences Act (POCSO), 2012. Both the provisions mandate that the identity of the child victim of a crime shall not be disclosed.
During the hearing, the bench asked Twitter’s counsel Sajjan Poovayya if the tweet made by Rahul Gandhi had been removed.
“Yes. It is against our policy as well, so it has been removed,” Advocate Sajjan Poovayya said.
“That’s very responsible. You have been prompt,” the bench replied.
However, the petitioner’s counsel objected to this, saying Twitter should file an affidavit and tell when the photo was removed.
Advocate Sajjan Poovayya said Twitter took responsibility and removed the photo. The petitioner has wrongly made Twitter a party to the case, he added.
The court will next take up the matter on September 27.
What did Rahul Gandhi tweet?
On August 4, Rahul Gandhi met the parents of the nine-year-old girl who was allegedly raped, murdered and forcibly cremated in Delhi Cantt.
After the meeting, Rahul Gandhi shared a picture of the meeting and tweeted in Hindi, “Parents’ tears are saying only one thing — their daughter, the daughter of this country, deserves justice. And I am with them on this path to justice.”
In the picture, the faces of the victim’s parents were clearly visible.
The tweet was taken down by Twitter on August 6. A day later, Rahul Gandhi’s Twitter account was “temporarily locked”.
BJP leader files complaint against Rahul Gandhi
A criminal complaint has been filed against Rahul Gandhi and Twitter by BJP leader Jitendra Gothwal. The complaint in this regard has been filed at the sessions court in Jaipur’s Bani Park.
